Settlement Against Local Authority That Failed To Repair Client’s Home
Our client owned a 900-year lease on a London flat. The freeholder, a local authority, failed utterly to comply with its responsibility to keep the property in a good state of repair. This meant our client was living in disgraceful conditions. We obtained substantial damages against the council and ensured full repairs were made to the property. Landlord’s Failure To Comply With Building Regulations
We recently settled a claim for a six-figure sum on behalf of a client whose landlord’s building works rendered his property uninhabitable. We also ensured the client was rehoused while remedial works were carried out and that the rent on the temporary accommodation was paid by the landlord.
Malicious Prosecution and False Arrest
Successful proceedings brought against the police, in the High Court, on behalf of a client suffering from multiple sclerosis. He was awarded damages and costs. Despite the arresting officer being aware of this, our client was arrested for drunk and disorderly behaviour, detained in police custody overnight, arrested and charged. In fact, he was suffering from MS symptoms. Initially, after our complaint, the Police investigated themselves and found that they were not at fault. With all due respect, a wholly predictable outcome and one which did not deter us from bringing proceedings.
Slander, the Procurement of False Arrest, and False Imprisonment
Successful proceedings in the High Court were brought on behalf of our client, in which he was awarded damages and costs. Our client’s claim for slander arose out of an allegation made by his employer. We bought a claim in High Court in proceedings against his employer. We also sued his employer and his employer’s business partner for procuring our client’s false arrest and false imprisonment by the Police, based on the slander made jointly by them, against our client.
Joint Property Venture Dispute Based on a Fraudulent Declaration of Trust.
Successful proceedings in the High Court were brought on behalf of our client. Our client was successful and eventually awarded a 50% share of the property, which the opposition claimed he had no interest in. Costs were also awarded in favour of our client on an indemnity basis, in part due to the fraud allegations made by the opposition. Fraud Carried Out by an Executor of a Will and Donee of a Power of Attorney
We acted for the sister of the deceased, the main beneficiary of her deceased brother’s will. We were able to secure a sum of £5,000,000 taken by a fraudulent executor and done of a power of attorney. It took considerable time and effort to locate the stolen funds as the fraudster had used multiple different accounts in which to transfer the deceased’s funds. Unsurprisingly, we were able to persuade the executor to return the monies to our client without recourse to litigation. Family Law
Our civil litigation solicitors successfully defended a claim against our client, an elderly lady, for a reduction in maintenance payments bought by her former husband. It was a complex case, as the husband was also an elderly man and had remarried and was living in Southern France. He pleaded reduced circumstances, which with the help of enquiry agents we were able to establish, was simply not the case. Costs were awarded to our client as well as an order for payment of arrears and an order that the maintenance payable continue at the rate directed payable by the Court in financial remedy proceedings.
