How to Solve Commercial Disputes Outside of Court?

March 28, 2022 by Emily

Even the most successful businesses can encounter commercial disputes with suppliers, co-partners, or clients. Before 1999 the only choice for resolving commercial disputes was always via a court process.

Times they are a changing, and a new court procedure was introduced which emphasised that court should be a last resort. Parties are very much encouraged by the courts to resolve their differences by Alternative Dispute Resolution (ADR).

What is a Commercial Dispute?

A commercial dispute is a legal process that allows unhappy parties to resolve their differences. In court, it is regarded as a last resort when communication between the parties to a dispute has broken down.

Commercial disputes are commonly:

  • Business disputes

  • Contract disputes

  • Shareholder disputes

  • Partnership disputes

  • Trade disputes

  • Construction disputes

  • Intellectual property disputes

How to Prepare for a Commercial Dispute?

Some business owners may assume that court is the only option to resolve a commercial dispute, but this is not the case. ADR is a process that resolves disputes without the need for court intervention, usually with help from a neutral third party. There are a wide variety of ADR procedures, the most popular are mediation and arbitration. Mediation involves a neutral person to assist the parties involved in reaching their solution to the dispute and is a non-binding process. Whereas arbitration involves a sole arbitrator or a three-member tribunal appointed to encourage parties to reach a legally binding decision.

What are Alternatives to Court?

Any court action is expensive. At Van Eaton Solicitors in Streatham Hill, we understand this is a major concern for clients. If possible, we will aim to resolve disputes through expert, cost-effective mediation and avoid the need for a court hearing. However, if we believe your case is strong and you are faced with an unreasonable opponent, we will energetically litigate the matter for you.

We also provide a free consultation to discuss your case, with our focus being on tailor-made solutions that protect your commercial interests. Our team of expert solicitors in London will always take account of the commercial background in which you work when formulating a legal strategy.
